We hereby present for your information the Notice and Consent Text regarding the Protection and Processing of Personal Data.

Pursuant to the provisions of the Personal Data Protection Law No. 6698 (KVKK), any information that identifies or makes your identity identifiable, including your special categories of personal data, shall be processed by Avatar Global in its capacity as Data Controller within the scope set out below. The processing of your Personal Data refers to any operation performed on such data, including collection, recording, storage, preservation, modification, reorganization, disclosure, transfer, acquisition, making available, classification, or prevention of use.

With this Information and Consent Text, it is aimed to inform customers about the personal data processing activities carried out by Avatar Global in accordance with the Law and to obtain their explicit consent for the situations specified below. As Avatar Global, we would like to emphasize that we attach the highest level of importance to the security of your personal data and continue our activities with the awareness that data security is a priority in all products and services we provide.

Purposes and Legal Grounds for Processing Your Personal Data:

Customers’ personal data are processed within the personal data processing conditions and purposes specified in Articles 5 and 6 of the Law, including: conducting necessary work by business units to enable relevant persons to benefit from products and services offered by Avatar Global and carrying out related business processes; performing commercial activities carried out by Avatar Global; planning and executing Avatar Global’s commercial and/or business strategies; ensuring the legal, technical, and commercial-occupational security of Avatar Global and relevant persons in business relations with Avatar Global; and planning and executing activities necessary for customizing and promoting products and services according to the preferences, usage habits, and needs of relevant persons.

In cases where the personal data processing conditions set forth in Articles 5/2 and 6/3 of the Law cannot be met, explicit consent of customers is required. Within this scope, personal data may be processed, in line with the customer’s consent, for purposes such as creating customer campaigns, cross-selling, determining target audiences, monitoring customer movements to enhance user experience, improving and personalizing the website and mobile application of Avatar Global, conducting direct and indirect marketing, personalized marketing and remarketing activities, segmentation, targeting, analysis, internal reporting, market research, planning and execution of customer satisfaction activities, customer relationship management processes, and planning and execution of sales and marketing processes aimed at building and/or increasing loyalty to Avatar Global’s products and/or services. Such data may be shared with the parties specified in this Information and Consent Text.

Transfer of Your Personal Data:

Customers’ personal data may be shared, within the scope of Articles 8 and 9 of the Law, with authorized representatives of Avatar Global, our affiliates, business partners, suppliers, shareholders, legally authorized public institutions and organizations, and private entities, for purposes including enabling relevant persons to benefit from products and services, conducting commercial activities, planning and executing business strategies, ensuring legal, technical and commercial security, and customizing and promoting products and services according to the preferences and needs of relevant persons.

Your Rights Under Article 11 of the Law:

By applying to Avatar Global, you have the right to:

I) learn whether your personal data are processed,
II) request information if processed,
III) learn the purpose of processing and whether they are used in accordance with that purpose,
IV) know the third parties to whom your data are transferred domestically or abroad,
V) request correction if processed incompletely or inaccurately,
VI) request deletion or destruction within the framework of Article 7 of the Law,
VII) request notification of the transactions made pursuant to subparagraphs (V) and (VI) to third parties to whom data have been transferred,
VIII) object to a result against you arising from analysis exclusively by automated systems,
IX) request compensation for damages in case of unlawful processing.

Data Controller You May Apply to Within the Scope of the Law:

In accordance with the KVKK regulations, you may submit your request to exercise the above-mentioned rights in writing or through other methods determined by the Personal Data Protection Board, via the specified communication channels, to Avatar Global.
